poc Dat~001 III'II'IIIIIIIII'II <br />sss <br />Section 816.44 Continued. <br /> <br />(d) When permanent diversions are constructed or stream channels re- <br />stored, after temporary diversions, the operator shall; <br />(1) Restore, enhance where practicable, or maintain natural riparian <br />vegetation on the banks of the stream; <br />(2) Establish or restore the stream to its natural meandering shape of <br />an environmentally acceptable gradient, as determined by the regulatory <br />authority; <br />(3) Establish or restore the stream to a longitudinal profile and <br />cross-section, including aquatic habitats (usually a pattern of riffles, <br />pools, and drops rather than uniform depth) that approximate premining <br />stream channel characteristics. <br />~• As explained in Section 816.44 (a), no diversions of perennial or <br />intermittent streams will occur within the mine plan area. <br />~~~ Section 816.45 Hydrologic balance: Sediment control measures. <br />(a) Appropriate sediment control measures shall be designed, con- <br />structed, and maintained using the best technology currently available <br />to: <br />(1) prevent, to the extent possible, additional contributions of sedi- <br />ment to streamflow or to runoff outside the permit area, <br />(2) meet the more stringent of applicable State or Federal effluent <br />limitations, <br />816-44 <br />
