These issues were raised and dealt with during the <br />public hearing and application process for the City of Ouray with the local planning commission <br />and City Council and officials. <br />7. The applicant did contact the local NRCS office and was notified that no soils data exist for this <br />area (per. Comm. between B. Briggs of AMC and NRCS personnel June 9, 2001). The applicant <br />will agree to make a test plot of screen materials during the first full year of operation to determine <br />suitability prior to using this material as a topsoil substitute. <br />8. The applicant believes no response is required to Colorado Division of Wildlife comments. <br />9. At this time and at no time in the memory of the applicant or of other locals within the area has <br />there been a defined channel for Bridalveil Creek. Though the USGS quad shows a channel the <br />applicant believes this is for reference only. Due to the nature of Bridalveil Creek, flow from <br />runoff or other storm events tends to wander across the property from year to year. The applicant <br />has included pages 41, 42 and 43 from Special Publication 30 by the Colorado Geological Survey <br />to support this claim. These pages are included for reference only and will not be included in the <br />application. <br />10. The debris flows from Bridalveil creek cover the highway at a minimum three or four times each <br />decade due to storm events. This is the result of the Colorado Department of Transportation <br />(CDOT) culvert being located about equal with the north boundary of the property and sized at <br />one 42-inch culvert. It should be noted that much larger culverts are required for flow events for <br />the Bridalveil Pit settling pond and roadway (two, six-foot culverts). Additionally, the CDOT has <br />depended on use of the highway ROW to transport flow from Bridalveil Creek (wherever it exits <br />into the ROW) to the existing 42-inch culvert. It is believed that until CDOT makes the <br />appropriate changes to their culvert location and size these events will continue to happen whether <br />the applicant creates the channel or not. <br />The applicant will create a channel appropriate to carry a 100 yeaz flood event. It is believed that <br />said channel will adequately carry flows from smaller flow events with a minimum of problems. <br />However if a flow event greater than 25 yeaz occurs while the operation is in progress, it is <br />expected that due to the debris flow nature of Bridalveil creek, Skyrocket creek and other creeks in <br />the immediate area, the channel created by the applicant will have minimum effect positive or <br />negative on the what actually happens. The publication referenced above in response 9 is an <br />excellent refence to the affects of such a flow on the City of Ouray and surrounding area. <br />11. Anew printout of Drawing MP-1 is included. <br />12. The applicant does intend to slope the benches to the highwalls at a very slight grade. Due to the <br />extremely porous nature of the debris flow fan, it is expelled that no surface water flow will occur <br />outside of the permit boundary. The applicant will commit to monitoring the results of such <br />sloping to insure that this plan succeeds in eliminating flow off the permitted site. The highwalls <br />designed for this pit are expected to be stable since historically this material has an angle of repose <br />much greater than 1.5:1. With the designed slight grade to the benches water is not expected to <br />flow over the highwall face and thus create instability. Since the applicant is in the process of <br />designing at least two businesses on these benches (storage buildings on the lowest bench and a <br />car wash on the middle bench) grading of the sites will continue after operation has concluded. <br />13. See response for 14 below. <br />14. The applicant has applied for CDOT access permit for both roads. The applications have been <br />included. In correspondence CDOT has been willing to give approval for one access at a time. <br />The change in use For the existing access road is expected, however since this road is pre-existing <br />no action should be taken.
