On Se tember 28 1981 the Mined Land Reclamation' <br />Board ("the board" approved operator's application for this <br />permit, fixed the amount of bond and directed that this permit <br />be issued upon the filing arith the Hined land Reclamation Division. <br />("the division") of bond in the amount so fixed in form and substance <br />approved by the division, and such band has been so furnished. <br />C. On Gentam}wr 7R 198L_, the board made the following <br />findings: <br />the application for [his permit complies with the <br />requirements of [he Colorado Mined Land Reclamation <br />Act, C.R.S. 1973, j4-32-101 et seq. as amended ("the <br />Act") and with all applicable local, state and federal <br />laws; <br />2. the operation trill not adversely affect the stability <br />of any significant, valuable, and permanent man-made <br />structure located within t~.ao hundred feet of the affected <br />land, except where there is an agreement bet~.veen oper- <br />ator and the persons having an interest in the struc- <br />ture that damage [o the structure is Co be compensated <br />for by operator; and <br />3. the proposed mining and reclamation operations can be <br />carried out in conformance ~.,ith the r?auirements of <br />the A,ct. <br />D. Operator has made a showing satisfactory to the board: <br />(1) that it will employ, during and after its underground <br />mining and surface operations, procedures reasonably designed <br />to minimize, as much as practicable, znvironmzntal disturb- <br />ance from such operation; (2) that _ till provide for <br />reclamation of [hz affected lands appropriate to the subse- <br />quent beneficial use of such lands; and (3) that, in thz <br />evznt of the failurz of its proposed reclamation plan, it <br />will take whatever mzasures may be necessary to assurz the <br />success of reclamation of the lands affected by such opera- <br />tions in accordance :rith C.R.S. 1973, 34-32-101 et sec. <br />Rev. 7/7/81 <br /> <br />
