BANTA, Director <br />October 25, 1988 <br />Mr,,ldichael Stanton <br />1210 South Park Drive <br />Monument, Colorado 80132 <br />RE: Fremont Paving Pit (File M-88-093) <br />Dear Mr, Stanton: <br />As we discussed on October 25, 1988, only one concern remains outstanding for <br />the Fremont Paving Pit 112 permit application, The Division's concern is that <br />mining operations could potentially impact the power poles which traverse the <br />proposed permit area, To resolve this concern, we suggest that Fremont Paving <br />commit to either not mining within 100 feet of the powerpoles, or provide a <br />statement from the owners of the powerline stating that any mining related <br />damage to those structures will be compensated for by Fremont Paving or its <br />successor [C.R.S. 34-32-115 (4)(d)], When this issue has been resolved, the <br />Division will recommend approval of the permit application, provided that the <br />proper notification requirements have been satisfied. <br />If you have any questions or comments, please contact me. <br />Sincerely, <br />~~~~~ i~ <br />Steven G.
