Box i79 <br />Gunnison, Colorado 81230 <br />Re: Schmalz Construction, Ltd, - "Schmalz Construction, Ltd." <br />File No. M-84-069 <br />Dear Mr. Wright: <br />On Friday, June 1, 1984, our Division received a call from a representative of <br />the U.S. Bureau of Land Management noting that legal description given in the <br />publication for the above captioned operation referred to Sec. 34, T49N, R1W. <br />It was represented to us that this was B.L.M. land and not Mr. Schmalz's <br />land. An examination of the map shows that, indeed, the legal description for <br />this operation should be Sec. 34, T50N, R1W. <br />Since our Rules and Regulations require publication to the nearest Section, <br />Township and Range, this invalidates the original publication (and any <br />publication done since). Thus, this publication will have to be done again <br />for two consecutive weeks with the correct legal description given. Anew <br />public comment period (as defined on the last page of the complete letter sent <br />on April 23, 1984) will need to be given, and if there are any adjacent <br />landowners (although I understand that there are not}, they should be <br />renotified by certified mail. <br />I should have noticed the problem with the legal description and mentioned it <br />to you. I am sorry for any oversight in my review and regret the <br />inconvenience it will cause you and your client now.
