Two listed endangered species, bald eagle (Haliaeetus leucocephalus) and peregrine <br />• falcon (Falco peregrinus) were documented in or nearthe study area during baseline investigations. <br />Both species occur in the study area only as transient individuals during migration. The permit area <br />does not provide important nesting, foraging or roosting habitat for either species. The measures <br />presented in the following discussions are designed to protect individuals of these species that may <br />occur on the permit area during mining and related activities. <br />General Wildlife Protection Measures. The following measures are designed to protect and enhance <br />the general wildlife resource during and after mining. These measures center on wildlife populations. <br />Fish and fish habitat are lacking on the permit area, therefore, there will be no direct impact to fish <br />populations as a result of mining and related activities in the New Horizon 2 area. Water runoff and <br />sediment are control led on the mine site pursuant to National Pol lotion Discharge Elimination System <br />(NPDES) Permits (refer to Peabody Tab 13, Facilities and Tab 17, Probable Hydrologic <br />Consequences). Consequently, there will be no negative impacts on any fish populations down- <br />drainagefrom the mine site, either during mining or after reclamation is completed. The reclamation <br />plan is designed to return the area to a postmining land use of agriculture predominated by irrigated <br />pasture. The irrigated pasture seed mixes, used on the majority of the area, v~ill provide good <br />ground cover that can be used as escape and nesting cover for birds, and as forage for the few deer <br />that may use the reGaimed area. The small size of the permit area and large amount of adjacent <br />habitat (see Map 2.04.11 in Section 2.04.11, Wildlife Resources Information) will further serve to <br />mitigate any impacts to wildlife populations. Because of abundant irrigation water supplies it is <br />expected that components of the swale type will reestablish naturally. <br />There are no wildlife migration routes through the permit area that would require access or special <br />fencing. <br />There have been no toxic water quality problems at the New Horizon 1 area, and no phase of the <br />anticipated operations in the New Horizon 2 area would indicate any future problems. NPDES permit <br />requirements provide additional protection of water quality. <br />Pesticides may be used in extreme cases if alternative mitigation measures fail to achieve adequate <br />results.
