Gravel parties of the first part as assignors and -HerOwn Enterprises- -~ Party of the second part as assignee._. Whereas, on June 9th, 1990, Frank C..Estey as Trustee for Estey Family Trusts, LESSOR entered into a lease agreement with ---Frank Levkulich and Al Martin doing business as S.F.I. Gravel, as LESSEES -- Granting and Leasing to said Lessee the right to prospect for, mine and remove SAND AND GRAVEL from a tract of land in the SEa of Sec. 13 in T7N of R91W of the 6th P.M., Moffat County, Colorado, more particularly described as follows: A parcel of land in Section 13 of T6N of R91W of the 6th P.M., Moffat County, Colorado, more particularly described as follows: Beginning at a point on the North-South Centerline of said Sec. 13 which point is South 1370 feet south of the North 1/4 corner of said Sec. 13; Thence South along the north-south centerline of said Sec. 13 a distance of 1272 feet more or less to the center of said Sec. 13; Thence West 1850 feet along the east-west center line of said Sec. 13; Thence North 500 feet; thence East 800 feet; thence North 772 feet; thence East 1050 feet more or less to the point of beginning, containing 32.54 acres, more or less. 170W THER);FORE, in consideration of the sum of Ten ($10.00) and other valuable consideration the Parties of the First Part do hereby assign all right, title and interest in and to the above described GRAVEL LEASE to: ~.- HerOwn Enterprises Intending to also assign all right, title and interest in and to that certain "Application for Gravel Mining Permit" now pending before the MINED LAND RECLAMATION BOARD of the State of Colorado.
