Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Reconsideration of Questions 22-30 in 2nd Adequacy Review Comments, MMRR Quarry, <br />Regulaz 112 Application, File No. M-2004-067 <br />Deaz Mr. Gesso: <br />The Division of Minerals and Geology (DMG) has reconsidered questions 22-30 in light of internal <br />consultation and discussions with the Colorado Department of Health and Environment, Air Pollution <br />Control, Hazardous Materials and Waste Management -Radiation Control, and Water Quality Control <br />Divisions and our subsequent issuance of a memorandum requesting assistance on radiation <br />monitoring dated July 13, 2005. The following letter will replace those questions and the questions aze <br />numbered in the same sequence as the 2nd Adequacy Review letter dated June 29, 2005. <br />22. Ori>~inal Question: The applicant has proposed a Monitoring Containment, and Control <br />Plan to address the potential for adverse impacts to human health, and the environment from <br />uranium mineralization resulting from quarrying activities and to ensure the operator's <br />compliance with all applicable Federal, State, and local regulations. During the previous <br />review period, the Division met with representatives from the Air Quality Control Division and <br />Radiation Management Program of the Colorado Department of Health (CDH) to discuss the <br />concerns expressed by I.L. Turner in reference to uranium mineralization from quarrying <br />activities. As a result of our discussion, it has come to the Division's attention that it maybe <br />more appropriate for the Monitoring, Containment, and Control Plan to address the presence <br />and impacts of radioactivity rather than uranium. The Division has asked for more input and <br />assistance from the CDH specialists to assess appropriate monitoring requirements and <br />piotocol. We anticipate a response from the CDH specialists by July 29, 2005 and will forward <br />their comments to the applicant as soon as they become available. <br />Disposition: No change. The question stands. <br />23. Ori¢inal Question: The applicant has proposed to "collect drill cuttings from at least one <br />(1) representative sample point and promptly perform assay work for uranium content." The <br />Division has asked the CDH to advise whether monitoring blast hole cuttings prior to blasting <br />would be an advisable way to monitor. We anticipate that measuring radiation from drill hole <br />cuttings from each blast hole maybe most useful and expedient.
