Mitigation Plan: <br />1. Where possible, coal leases requested by CWI have been located so as to mini- <br />mize the effect of undermining. 'ibis is especially true in the west and Main <br />Roatcap Creek areas. Zhe lease boundary was located so as to put the stream <br />channel completely and substantially outside the permit area and to undermine <br />as small a portion of the overall watershed as possible. 'This approach maxi- <br />mizes protection to these water resources. <br />2. Substantial protection of water rights can be afforded in conjunction with <br />regular mrnitoring and quick repair of subsidence-induced problems. Although <br />CWI projects small effects due to subsidence, CWI has endeavored to ensure <br />quick repair by anticipating and designing corrective measures. Fefer to <br />Rangeland impairs in the Subsidence ]pair Handbook. <br />3. CWI has informed ditch companies of an intent to construct transportation <br />improvements such as buried pipelines or concrete linings to ensure equiva- <br />lent flows. CWI will work with each ditch company rn a case-by-case basis <br />for these improvements. <br />4. Finally, west Reservoir water could be delivered to the Bruce Ditch, the <br />Goodenough Ditch, the IZoatcap Ditch, the RDbbins Ditch, and the Roberts/ <br />• Stucker Ditch. If transportation improvements could not offset the losses <br />due to undermining of the watershed area, West F~servoir water would be used <br />to supplement flows. CWI would process a legal change in point of diversion. <br />The West Reservoir water currently is used at CWI-owned property on the <br />Basin, which is not a potential AVF. <br />Summary <br />CWI intends to mitigate all water losses. It is prudent to take care of this on <br />a case-by-case basis because of the complexities of water replacement issues. <br />CWI has maintained close communications with affected ditch companies, and these <br />ditch companies have responded positively to this approach in water replacement. <br />• <br />
