Covey: <br />Pursuant to Rule 2.34 of the Rules and Regulations, enclosed is a copy of a <br />protest. filed by Mr. Larry Christiansen and Ms. Jill Dohm Christiansen <br />pertaining to the above referenced operation. <br />The apparent conflict in land ownership boundaries should be resolved. One <br />method could be to have an independent surveyor review your submitted map and <br />ascertain in a written letter that it is correct. <br />The comment "The shop may be expanded to handle concentrating facilities for <br />the ore." should be discussed more fully. If you indeed have plans for such <br />a facility, please discuss the process involved, the equipment to be used, and <br />the amount of area required for the operation. If you are unsure at this time <br />of your need for a facility, you may wish to delete this comment from your <br />current application and file a Technical Revision in the future to add your <br />facility to your site at that time. <br />The comment "We must, however, take steps to keep run-off water where it <br />belongs and not in the workings." should be discussed more fully as well. The <br />comment> in your application's Exhibit D by Richard Mullaney, District <br />Conservationist for the USDA Soil Conservation Service, regarding a berm and <br />diversion ditch should be incorporated into your plans to satisfy our <br />Guidline~s outlined in Section 34-32-116(7) of the Act and Rule 6 in the Rules <br />and Regulations <br />The concern about the powder and detonator storage areas should be resolved to <br />the satisfaction of the Colorado Division of Mines. The Mined Land <br />Reclamation Division does not regulate the use of explosives. Questions <br />regarding the use of explosives as part of a mining operation should be <br />addressed to Mr. Joe Nugent at 866-3401. Additionally, the concern about the <br />proximity of the operation to a residence should be in compliance with both <br />the Division of Mines regulations and Boulder County's codes.
