Simpson
Suer Engineer
Seven I wine. RE
Dwnion Engmee~
This letter concerns evaporation from the [3ent County Ready Mix pit, MLRD #M86-112. Ow
revic+v of information about your gravel pit indicates that it was constructed Ibllowing a 1986
application to the Colorado Mined Land Reclamation Division. At that time (here was an old pond
+ahich was not to be involved in mining under the 1986 permit. The 1986 proposal called for a dry
pit to be located adjacent to the old pond. We understand that excavation has resulted in a wet pit
which incorporates the old pit. 71te differences be[+veen what was permitted and what was
constructed will require a new permit from MLRD and we understand you will be seeking such a
new permit.
\'/o have recently received a letter from John Singletary indicating that 1'ou +vould be joining one
of the ground water users associations for augmentation of your gravel pit. n follow up conversation
with Mr. Singletary has confirmed that you intend to submit a well permit application with evidence
of membership in a groundwater association by Nov. 1G, 1994. Colorado Revised Suuutcs, sec. 37-
90-137(1 1) et. seq., require well permits and augmcNa(ion for all graycl minin~~ operations +ahich
expose ground water to the atmosphere after January I, 1981. This letter is to smte that we shall
expect a reasonably acceptable permit application and substitute supply plan to be filed no later than
December 22, 1994, otherwise follow up enforcement action may become necessary.
1~~r look li~nvard to continuing to work with Me Singletary toward a resolution of ibis problem as
we await a detertination as to the acceptability of ground water association membership as a basis
of a Substitute Water Supply plan.
cc..lohn Singletary ~
13ob Oswald, MLRD
Dan Neuhold.
