These comments were contained in a letter prepared by Tom <br />Schreiner of your office dated March 5, 2001. <br />As part of our response to these comments, the applicant would like to remove the <br />Renewable Resource Area from the mining plan. The concerns that have been expressed <br />by the Division on this portion of the site, as well as those that came forward through the <br />processing of the 404 permit, convinced the applicant that it would improve the viability <br />and political acceptance of the plan to eliminate the Renewable Resource Area. Revised <br />Mine Plan Maps (C-1 and C-2) and Reclamation Plan Maps (F-1 and F-2) have been <br />prepared to reflect this change. By removing the RRA from the plan, the area within the <br />active mining boundary is reduced from 146.68 acres to 122.96 acres. The remaining <br />four mining phases (West Property Line to Horse Fence; Slough to East Property Line; <br />West End; Dry Creek to Slough) and the two areas designated for potential future mining <br />(Snyder Ranch to Mamm Creek; West Horse Fence to Snyder Ranch) are still in the plan <br />as shown in the initial and supplemental submittal information. The 100' buffer area that <br />had been in place at the north edge of the RRA has been removed and is replaced with a <br />]00' buffer along the north edge of the first two mining phases (West Property Line to <br />Horse Fence and Slough to East Property Line). The top of the berms for the reclaimed <br />ponds have been raised by a maximum of 5.5 feet at cross section 440 and by less than 1 <br />foot in the majority of areas in order to keep the 50 year flood from inundating the ponds. <br />The U.S. Fish and Wildlife Service, consulting on the 404 permit, had concerns about <br />non-native fish species escaping from these ponds and having negative impacts on the <br />native fish in this stretch of the river. Designing the reclaimed ponds to withstand the 50 <br />year flood satisfied their concern on this matter. Information on the determination of the <br />flood levels across the site and their impacts is discussed in the attached flood plain study <br />prepazed by High Country Engineering. <br />Below is our response to the March 5, 2001 letter from the Division: <br />box 947 -eagle, co 81631 - 970.328.6299 -fax 970.328.6254 <br />
