What measures has the <br />applicant taken to meet these requirements? <br />Under Exhibit D-Mining Plan-Water Diversions and Impoundments, the applicant states <br />"Although an imgation system does exist at the site, it will not be in use during operation. <br />However, it will be reinstalled after mining is complete." <br />Please indicate the owner(s) of this system and whether this system will be relocated. If the <br />system will be relocated, provide applicable designs an explanation of how the water rights <br />of the users of this ditch will be protected, and agreements from the applicable owner(s) of <br />struchues that will be disturbed by the mining operation. <br />Exhibit C depicts a setback from the Big Thompson River, which appears to be <br />approximately 40 feet on the east side of the permit azea. The Division recommends a <br />minimum 100-foot distance buffer from the affected area to the Big Thompson River. Please <br />provide the Division with a setback distance and describe how the setback boundary and <br />protected area will be marked and protected from inadvertent disturbance. <br />4. Rule 6.4.12 Exhibit L-Reclamation Costs <br />The costs presented in Exhibit L appear to be reasonable, except for Item 5-Liner Material. For this <br />item, please refer to the attached March 13, 2001 memo from Allen Sorenson to Gregg Squire, <br />regarding Reclamation Permii Application to Construct a Lined Gravel Pit, Coulson Excavating <br />Company, Inc., Bonner Pit, File No. M-2000-156. <br />In addition to the Exhibit L and the Sorenson memo costs, additional costs must be added for <br />mobilization and demobilization, job supervision, profit, insurance and other indirect costs. A final <br />figure will be computed upon resolution of the adequacy review issues. <br />5. Attached is a separate memo from Allen Sorenson, which addresses additional hydrologic and pit <br />liner issues. Please address these items and consider them to be part of this adequacy review. <br />Please be advised that the Bonner Pit application may be deemed inadequate and the application may be <br />denied on April 12, 2001, unless the above-mentioned adequacy review items are addressed to the satisfaction <br />of the Division. <br />If you feel that more time is needed to complete your reply, the Division can grant an extension of the <br />decision date. This will be done upon receipt of a written waiver of your right to a decision by April 12, 2001 <br />and a request for additional time.
