~ i ~ <br />' EXHIBIT A- LEGAL DESCRIPTION <br />This application requests a permit for mining gravel on a 14.6 acre tract located in Section 34, <br />' Township 11 South, Range 67 West, in north El Paso County according to Rule 2 of the Mineral <br />Rules and Regulations of the Colorado Mined Land Reclamation Board (CRS 34-32-112 for new <br />applications). The petitioners, Raymond and Robert Dellacroce, own a 722 acre ranch surrounding the <br />' proposed gravel pit which is locazed on Baptist Road a mile west of I-25 and further shown on Figure <br />2, Exhibit A (assessor's number 71000-00-256). Included with this request is reclamation of an <br />existing and previously closed pit site, herein referred to as the "lower sedimentation pond" and <br />' reclamation of an existing 15' wide pit access road. This application also presents two alternate means <br />of access to the proposed pit site with further discussion in Exhibit C. On August 16, 1993 the El <br />Paso County Board of County Commissioners approved the petitioners' rryuest ro establish the 14.6 <br />acre mineral resource extraction operation. Copies of approval conditions and notations are included <br />within the Appendix of this report. <br />' Figure 1, Exhibit A illustrates a plaz of the 14.6 acre proposed pit site with regard to its location in <br />Section 34. Figure 3, Exhibit B depicts the location of the 2.4 acre lower sedimentation pond with <br />regard to the pit site and the section lines. The existing pit access road and the two alternate access <br />roads are shown on the aerial photograph in Figure 1, Exhibit C.
