This agreement shall be for a period of five (5) years from this date, ending and terminating at 12:00 o'clock Noon on the 15tH day of June 1977 unless sooner terminated as hereinafter provided. 3. Second party agrees to move in whatever equipment is necessary upon the premises above described to produce sand and gravel from said premises, with the right to stock pile upon the above described premises such sand and gravel and from such stock piles load and sell such sand and gravel. 4. It is understood and agreed that this agreement shall be operated under a fiscal year, each fiscal year ending June 15th of the calendar year such that the first fiscal year shall be from the period June 15, 1972 to June 15, 1973; the second fiscal year shall be from the period June 15, 1973 to June 15, 1979; the third fiscal year shall be from the period June 15, 1974 to J»ne 15, 1975; the fourth fiscal year shall be from the period June 15, 1975 to June 15, 1976; the fifth fiscal year shall be from the period June 15, 1976 to June ].5, 1977. Second party agrees to pay for such sand and gravel produced and removed from the above described premises the following amounts: First fiscal year - 16~ per ton Second fiscal year - 12~ per ton Third fiscal year - 14,z~ per ton Fourth fiscal year - 16~ per ton Fifth fiscal year - 18~ per ton Such weight of materials produced and removed from said premises to be kept by second party as reflected by scales to be installed by second party upon the above described premises, and second party shall keep an accurate re<;ord of all scale weights of all sand and gravel removed from said premises. Such scales to be installed before second party shall remove any sand or gravel from said premises. 5. Second party sh3 11 have the right of ingress and egre:as from the above described premises to U. S. Highway 550, which shall be in a Northwesterly direction from the above described premises, the use of which read as access from the above described premises to U. S. Highway 550 shall be for first parties, their heirs, successors and assigns in title to said premises, and second party, its successors or assigns, and not as a public or access road for other persons without permission in writing from each of the parties hereto. --~--
