due or paid Walden Coal Company under the schedule set forth above in any one calendar year are less than $34,000.00, then the amount less than $39,000.00 shall be due Flatiron Paving Company within thirty (30) days after the end of the calendar year for which such payments are due. Any amounts paid as a minimum royalty shall be subtracted from subse- quent royalties due Flatiron Paving Company for the pro- duction of coal from the Subleased premises. The method of calculating the royalty due, and the terms of the payment of the royalty shall be the same as provided in the Bourg and Knowles Leases. All books and records kept by Walden Coal Company pursuant to the require- ments of the Bourg and Knowles Leases may be inspected by Flatiron Paving Company or its representatives at any rea- sonable time within two (2) years of any payment questioned. All payments made by Walden Coal Company to Flatiron Paving Company under this Sublease shall be made to Flatiron Paving Company, P. 0. Box 229, Boulder, Colorado 80306, or to such address as Flatiron Paving Company, or its assigns, may properly communicate to Walden Coal Company. All payments may be made by check or draft of Walden Coal Company or any assignee thereof. All payments shall be mailed or delivered on or before the payment due date. VIII. • Default and Disputes If Walden Coal Company shall default in the payment of any sums due Flatiron Paving Company, Flatiron Paving Com- pany shall have the option, after written notice setting forth such default, to terminate this Sublease at the end of thirty (30) days from the date of receipt of such notice by [9alden Coal Company, provided, however, that Walden Coal Company may preserve this Sublease and prevent such termi- nation by bringing current payments due Flatiron Paving Company within said thirty (30) da}'s of receipt by [Calden -5-
