On Exhibit "B" enclosed is a notarized document <br />(Exhibit "L") that should satisfy that requirement regarding the <br />fence. <br />We have contacted the Water Control Division of the Health <br />Department and they are suppose to be sending us an application <br />as well as a written decision as to whether or not we need a <br />discharge permit. It was our understanding that we did not need <br />one but we are having a great deal of difficulty because of <br />holidays and vacations contacting the correct person and <br />obtaining a decision. Therefore, we are asking for an extension <br />of the decision date which is presently set for January 9, 1998, <br />as we are sure we cannot have this problem resolved by that time. <br />We are enclosing an Exhibit "D" which should meet the <br />requirements in your letter as well as a notice to the mayor of <br />Branson, Colorado to satisfy the requirement in Exhibit "H". <br />Also enclosed is a copy of the public notice as it appeared in <br />our local newspaper, The Chronicle News, on December 16, 1997, as <br />well as notifications sent by Certified Mail/Return Receipt <br />Requested to the landowner and the adjacent landowners. <br />If anything further is required, please advise.
