The applicant mentions dewatering the gravel pit and
using this water for process water. We view this use of gravel pit water
as putting the ground water to a beneficial use which would thus make the
pit a "well"; and in order to use the "well", a well permit must be obtained
in order to not be in violation of CRS 1973, 37-90-137. The conditional
surface water right that is owned by the applicant does not allow the use of
ground water as the source of mining water. At the present time, the
applicant would not have any problem obtaining a well permit in the proposed
protect area,
We have no obtections to the application as long as the applicant obtains
the needed well permit.
,(~iX ~t
Hal D.
