Dept. of Alatura) Ncsc!~rces <br />TO: MINED LAND RECLAMATION BOARD, ATTN: BRAD DANES <br />FROM: HAL D, SIMPSON, CHIEF, WATER MANAGEMENT BRANCH <br />SUBJECT: QUILLIN CO, - "BUNN RANCH PIT", MOFFAT COUNTY, <br />APPLICATION FOR MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application for a gravel <br />pit near Craig. The applicant mentions dewatering the gravel pit and <br />using this water for process water. We view this use of gravel pit water <br />as putting the ground water to a beneficial use which would thus make the <br />pit a "well"; and in order to use the "well", a well permit must be obtained <br />in order to not be in violation of CRS 1973, 37-90-137. The conditional <br />surface water right that is owned by the applicant does not allow the use of <br />ground water as the source of mining water. At the present time, the <br />applicant would not have any problem obtaining a well permit in the proposed <br />protect area, <br />We have no obtections to the application as long as the applicant obtains <br />the needed well permit. <br />,(~iX ~t <br />Hal D.
