The PertniVee, DG Ilusldn Corrstructicn Company desires to conduct a inuring operation imown <br />as Pino Pit, for the purpose of extracting sand and gravel. The PemrAtee will nd come any secondary <br />commodities. <br />B. On November 7, 2000 the Mined Land Reclamation Board (the "Board") approved the <br />Pennittee's application for this permit, fixed the amount ofthe financial warranty and directed that this permit be <br />issued upon the filing with the Division of Minerals and Geology (the "Division") of perforrrrance warranty and <br />financial warranty (or warranties) ur the amamt so fixed in form and substance approved by the Division. Said <br />warranties have been filed with the Division. <br />C. ff the Permutee desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On November 7, 2000 the Board made the following findings: <br />1. The application for this pemrit complies with the requiremeNs of the Colorado Mured <br />Land Reclamation Ad for the Extraction of Coostnrction Materials, C.RS. 34-32.5-101 et seg., az arnmded, and <br />with all applicable local, state and federal laws; <br />2. The operation will nct adversely affect the stability of any signiScarrt, valuable, and <br />pemrarrent mananade structure located within two hundred feet of the Affected Land, except where there is an <br />agreemart between the Operator and the parsers having an interest in the structure that damage to the strucUrre is <br />to be camparsated for by the Permittee; and; <br />
