Stormwater Requirements (continued) I <br />d) The Division finds that the permittee has shown reasonable grounds consistent with the Federal and State <br />statutes and regulations for such termination; and <br />I <br />e) Fee requirements of Section 61.15.0 of the Colorado Discharge Permit System Regulations have been met. <br />i <br />Continued coverage may be required after reclamation or remediation has been completed if the~Division has <br />shown or has reason to suspect that the stormwater discharge may contribute to a violation of a water quality <br />standard. <br />i. Stormwater Defutitions <br />1. Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance procedwes, <br />and other management practices to prevent or reduce the pollution of waters of the State. BMPs also include <br />treatment, operating procedwes, and practices to control site runoff, spillage or leaks, waste disposal, or <br />drainage from material storage. BMPs include structural and nonstructural controls. <br />2. Operator: the individual who has day-today supervision and control of activities occurring at the mine site. <br />3. Remediation, as used in this permit, means actions taken to reduce or eliminate the overall adverse <br />environmental impact associated with a pollutant sowce. The term includes actions such as re-Touting of surface <br />flows, re-location or a pollutant sowce, the addition of pollutant neutralizing or immobilizing substances, • <br />capping and re-vegetation. j <br />4. Significant Materials include but are not limited to: raw materials; fuels; materials such as metallic produce; <br />hazardous substances designated under section 101(14) of CERCLA; fertilizers; pesticides; and waste produce such <br />as ashes, slag and sludge that have the potential to be released with stormwater discharge. ~ <br />E. GENERAL MONITORING, SAMPLING AND REPORTING REQUHtE1tiIENTS <br />1. Routine Reporting of Data <br />Reporting of the data gathered in compliance with Part I.B.1 shall be on a quarterly basis. Reporting of all data <br />gathered shall comply with the requirements of Part I.E. (General Requirements). Monitoring resole shall be <br />summarized for each calendar quarter and reported on Division approved dischazge monitoring report (DMR) forms <br />(EPA form 3320-1). One form shall be mailed to the Water Quality Control Division, as indicatedlbelow, so that <br />the DMR is received no later titan the 28th day of the month following the end of the quarter (for example, the <br />DMR for the first calendar quarter must be received by the Division by April 28th). If no discharge occurs during <br />the reporting period, "No Discharge" shall be repotted. ~ <br />The DMR forms consist of four pages -the top "original" copy, and three attached no-cartton-required copies.
