Stormwater Requirements (continued) I d) The Division finds that the permittee has shown reasonable grounds consistent with the Federal and State statutes and regulations for such termination; and I e) Fee requirements of Section 61.15.0 of the Colorado Discharge Permit System Regulations have been met. i Continued coverage may be required after reclamation or remediation has been completed if the~Division has shown or has reason to suspect that the stormwater discharge may contribute to a violation of a water quality standard. i. Stormwater Defutitions 1. Best management practices (BMPs): schedules of activities, prohibitions of practices, maintenance procedwes, and other management practices to prevent or reduce the pollution of waters of the State. BMPs also include treatment, operating procedwes, and practices to control site runoff, spillage or leaks, waste disposal, or drainage from material storage. BMPs include structural and nonstructural controls. 2. Operator: the individual who has day-today supervision and control of activities occurring at the mine site. 3. Remediation, as used in this permit, means actions taken to reduce or eliminate the overall adverse environmental impact associated with a pollutant sowce. The term includes actions such as re-Touting of surface flows, re-location or a pollutant sowce, the addition of pollutant neutralizing or immobilizing substances, • capping and re-vegetation. j 4. Significant Materials include but are not limited to: raw materials; fuels; materials such as metallic produce; hazardous substances designated under section 101(14) of CERCLA; fertilizers; pesticides; and waste produce such as ashes, slag and sludge that have the potential to be released with stormwater discharge. ~ E. GENERAL MONITORING, SAMPLING AND REPORTING REQUHtE1tiIENTS 1. Routine Reporting of Data Reporting of the data gathered in compliance with Part I.B.1 shall be on a quarterly basis. Reporting of all data gathered shall comply with the requirements of Part I.E. (General Requirements). Monitoring resole shall be summarized for each calendar quarter and reported on Division approved dischazge monitoring report (DMR) forms (EPA form 3320-1). One form shall be mailed to the Water Quality Control Division, as indicatedlbelow, so that the DMR is received no later titan the 28th day of the month following the end of the quarter (for example, the DMR for the first calendar quarter must be received by the Division by April 28th). If no discharge occurs during the reporting period, "No Discharge" shall be repotted. ~ The DMR forms consist of four pages -the top "original" copy, and three attached no-cartton-required copies.
