Box 616 <br />Oak Creek, CO 80467 <br />File No. 77-519 <br />Dear Sirs: <br />Action by the Colorado Mined Land Reclamation Board at their November 14, <br />1984, meeting resulted in a finding that there is reason to believe that a <br />violation to the permit for the above captioned operation has occurred <br />(34-32-124(1), C.R.S.). <br />This matter will be on the Board agenda as a Formal Public Hearing on December <br />13, 1984, for consideration of the possible violation and possible cease and <br />desist order on this operation, and possible corrective action(s) for the <br />violation. <br />At the hearing, which will be held in Room 110 of 1313 Sherman Street, Denver, <br />Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be <br />considered, you will have the opportunity to be represented and heard. It <br />will be reiterated that you have been in violation of the permit, specifically <br />the following provisions: <br />Failure to provide notice of intent and annual fees as required by <br />34-32-110(4), C.R.S. <br />If the Board finds a violation at this hearing, it may set the matter for <br />consideration of possible civil penalties for the violation at a subsequent <br />hearing.
