• Section 780.11 (b) Continued.
drainage (as established by baseline water quality data). The only
exception would be if any of the remaining ponds are identified as
beneficial relative to use as livestock or wildlife water sources
consistent with applicable provisions of Rule 4.05.9(13), and approved
for retention by the DMG.
Pond reclamation will typically involve removal and disposal of
discharge structures, grading of any embankment fill material into the
pond basin, and grading of the pond disturbance area to blend with the
surrounding terrain. Soil required for reclamation of sedimentation
pond sites has been stored in soil stockpiles adjacent to pond areas
as shown on Map 31a, Kerr Mine Area Soil Removal and Storage, until
such time as sedimentation pond reclamation occurs. The methods to be
implemented to prevent deterioration of soil during storage are fully
described under Section 780.18 and Sections 616.21 through 816.25 of
this application. Upon removal of each sedimentation pond, the
affected land will be regraded and revegetated in accordance with
• Sections 816.100-816.106 and 816.111-81 6.117.
Ponds A, B, D, and E are existing sedimentation ponds. They contain
water throughout all or most of the year and typically have some
established riparian vegetation. Kerr proposes to retain Ponds A, B,
D, and E as permanent impoundments. These ponds would be used as
stock ponds for livestock grazing and would continue to be used as
small impoundments for wildlife use and habitat as they have been
since 1979. Both livestock grazing and wildlife habitat are
components of the proposed and approved postmining land use.
Pond P. was created by constructing an embankment across an existing
natural drainage tc impound intermittent flows and disturbed area
runoff from the southern portion of the current permit area and
adjacent areas.
Fond B was created by excavating a depression in an existing ephemeral
drainage channel and constructing a low embankment of sufficient .size
• to retain the required volume of runoff from a portion of the
disturbed area. Originally this pond did not retain water year-round,
~~`~~ 780-1U Revised April 2009
M 2-3q
