Long <br />Division Director <br />On May 21, 1997, the Mined Land Reclamation Boazd approved your request for a Declaratory Order exempting <br />ITEC Mineral, Inc., frem having to obtain a Mined Land Reclamation Board mining permit, or a Notice of Intent <br />to conduct prospecting operations. The Board did attach conditions to the permit waiver approval. These <br />conditions are: <br />The operator shall strictly follow the procedures that were described at the May 97 Boazd <br />hearing. Any activities that vary significantly from what was described at the hearing may void <br />this Declazatory Order. <br />2. Any new disturbances created by your activities that aze outside of the mining dump areas may <br />need a Notice of Intent for prospecting where: <br />any single disturbance exceeds 1600 square feet; <br />you have more than two such disturbances in any one acre; or <br />you have more than S cumulative acres state wide due to your proposed activity. <br />(Please see Section 34-32-103(12) of the Colorado Mined Land Reclamation Act. ) <br />If you have any question concerning this Declaratory Order, please call Carl Mount or me at (303) 866-3567. <br />Sincerely, <br />H.
