"Ihe Permittee, Grasser Construction, Inc. desires to conduct a mining operation known as <br />McCormick Pi[, for the purpose of extracting Sand and gravel. The Pemrittee will not mine any secondary <br />commodities at this site. <br />B. On July 25, 2001 the Mined Land Reclamation Board (the "Board's approved the Permittee's <br />apphcation for this permit, fixed the amount of the financial wartarrty and directed that this pemrit be issued upon <br />the filing with the Division of Minerals and Geology (the "Division's of perfortnartce warranty and financial <br />warranty (or wartartties) ur the amount so fixed in forth and substance approved by the Division. Said warranties <br />have bear filed with the Division. <br />C. Ifthe Pemrilfee delves to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On July 25, 2001 the Board made the following findings: <br />1. The application for this permit corr~Ges with the requiremerrts of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Constnrction Materials, C.R.S. 34-32.5-101 et spa ., as amalded, and <br />with all apphcable local, state and federal laws; <br />2. The operation will nd adversely affect the stability of any significarrt, valuable, and <br />permanent man-made sVUdure located within two hundred fed of the Affected Land, except where there is an <br />agreement between the Operator and the persons having an interest in the structure that damage to the structure is <br />to be corr~ensated for by the Perrnittee; and; <br />
