Hwy 85 <br />Sedalia, CO 80135 <br />Re: Mined Land Reclamation Board Gravel Pit Application <br />Pioneer Farm -Pioneer Sand <br />Dear Mr. Sibson <br />Pioneer Sand, Inc. is applying for a gravel mining permit from the Mined Land Reclamation <br />Boazd for a permit on property located (South 1/2, Section 34, Township 4 South, Range 64 <br />West of the 6th P.M.). IREA has an easement on the eastern edge of property. <br />We will be crossing the southern end of the easement with our haul road. <br />(See enclosed map). <br />The Rules and Regulations of the Colorado Mined Land Reclamation Board effective January <br />1996 in 6.4.19 Exhibit S -Permanent Man-Made Structures reads as follows: <br />"Where the mining operation will adversely affect the stability of any significant, valuable or <br />permanent man-made structure located within two hundred (200) feet of affected land, the <br />applicant may either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest in <br />the structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities <br />occurring at [he mining operation." <br />"Your Brand of People" <br />
