We do not anticipate encountering the water table if mining only goes to a depth of <br />20 feet. We will commit to limiting the excavation to a minimum of two (two) feet <br />above the groundwater surface and to immediately backfill any exposed <br />groundwater should it accidentally be encountered during the mining operation. <br />6.3.12 EXHIBIT L -Permanent Man-Made Structures <br />The applicant specifies there are tow (2) electric power poles in the pit area, i.e.: <br />within 200 feet of the excavation, that are owned by Y-W Electric. Please <br />demonstrate how the applicant will comply with Rule 6.3.12. Applicable options <br />available to the applicant are as follows: <br />a) Provide a notarized agreement between the Applicant and the Person(s) <br />having an interest in the structure, that the Applicant is to provide <br />compensation for any damage to the structure; or <br />b) Where such an agreement cannot be reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall <br />not be damaged by activities occurring at the mining operation; or <br />c) Where such structure is a utility, the Applicant may supply a notarized letter, <br />on utility letterhead, from the owner(s) of the utility that the mining and <br />reclamation activities, as proposed, will have "no negative effect" on their <br />utility. <br />We have been in contact with Y-W Electric Association regarding their power poles. <br />Mr. David Allen of Y-W should have sent you a letter indicating that they plan to <br />retire that line. As it is retired, they plan to remove the poles in question. These <br />structures will no longer be an issue as the sand is mined. <br />Attached as part of this response is a copy of the Proof of Publication and proof of <br />mailings to adjoining landowners. A signed copy indicating this information has been <br />filed with the Yuma County Clerk is also attached. If any additional information is <br />required, please give me a call at 970-854-3778.
