Your commitment
for resolution of the Flood controVmitigation concem is appreciated and accepted. The Division's position
on wetlands remains the same: No wetlands' creation, mitigation, or enhancement may occur within the
permit area until [he applicant has provided an approvable wetlands reclamation plan for the
Green/Croissant Property. I have attached copies of the Division's previous adequacy letters' which outline
[he rationale and legal authority for information that must be included in such a wetlands' reclamation plan.
The Division recognizes that the approved 404 Permit may provide some of the information required for
[he wetlands reclamation plan.
Please contact me at (303) 866-3567 if you have any questions or wish to discuss the wetlands concem an
or before the July 9, 2001 decision date.
Sincerely,
~,~41.~~
Thomas A.
