<br />Applicant's representatives are hereby made conditions of .is approval.
<br />3. T},e operations of the Willow Bend Sandpit s},all be, at all times,
<br />in compliance wit}, U,e findings of this Board as stated he sin above. Speci-
<br />fically, at no time s},all t},e extractive operations go bey nd the actual sand
<br />bar area located wit},in t},e boundaries of the affected min ng area as stated
<br />on the land use application, consisting of about 1.0 t 1.5 acres. T},e
<br />operations s}.all consist of only one meditin-sized front- nd loader and, at
<br />any given time, only one medium-sized dump tnick, of ten o twelve yards of
<br />hauling capacity, shall be loaded on tk,e site. There i to be no stock-
<br />piling, crus},ing, or processing of any materials at tl,e si a nor any storage
<br />of equipment, machinery, or vehicles, except for t},e front end loader during
<br />actual mining operations, at t},e cite. All equipment an vehicles located
<br />and operated on t}.e site s}.all Dave fully operationa muffler devices
<br />attached at all times during operation. T},e hours of eration shall be
<br />confined to daylight, and in no case earlier tt,an 7:30 a.m. nor later than
<br />6:30 p.m., Monday through Saturday. There is to be no c shing or material
<br />processing operations conducted on the site at any time. All }.aiding and
<br />equipment movement is to be confined to the mine area and t e haul road to
<br />U. S. Hwy. 550, The haul road to U. 5. Hwy. 550 shall be g aveled and dust-
<br />retardant applied, as necessary, to control fugitive dust T},e operator is
<br />to use appropriate techniques and materials to control y fugitive dust
<br />whit}, may be generated by t},e operation so as to preve t any detectable
<br />levels of particulates from leaving the site. There are t be no operations
<br />on t}ie site during periods of t,igh water or during perio s when t},e Animas
<br />River is at flood stage. Any equipment or machinery pr sent on tl,e site
<br />shall be promptly removed during periods of high water or when flood danger
<br />is present. There shall not be any encroachments, fill structures, or
<br />substantial improvements located witt,in t},e floodway of tl,e Animas River.
<br />4. Periodic Review and Enforcement: This land use approval is
<br />expressly contingent upon and subject to the operator' receipt of and
<br />compliance with all required state permits or approvals, ncluding, but not
<br />limited to, the permit for the proposed operation required from the Colorado
<br />Mined Land Reclamation Board. Should t.},e Colorado Mined Land Reclamation
<br />Board or any ot},er state agency, whose permit or approval i required for the
<br />Sandpit operation, suspend or revoke sttch permit or approv 1 for the opera-
<br />tion, the County's land use approval shall be deemed suspen ed or revoked, as
<br />appropriate. T},e operation of the Sandpit shall be reviews by this Board on
<br />a biannual basis to determine if t},e operation is in co pliance with t},e
<br />terms and conditions of County land use approval set fort in t},is Resolu-
<br />tion. Such biannual review shall be held within the ninet (90) day period
<br />preceding such anniversary date. Any written allegations at the Sandpit is
<br />operating in violation of the terms and conditions of pproval shall be
<br />referred to t},e County planning staff for investigation. The County staff
<br />sk,all promptly investigate any such written allegations con erninq violations
<br />and report their findings to this Board.
