I have several questions and <br />comments that I have organized on an exhibit-by-exhibit basis below. Any <br />exhibits or parts ,thereof not mentioned are considered adequate at this time. <br />Before the Sept. 23-24, 1981 meeting, I will need the proof of the second <br />' publication with the corrected legal description For the operation. As I <br />J~mentioned to you, I do not feel that the adjacent landowners will need to be <br />ll/// ~~`renotified. To date, the Division has not received any public protests con- <br />~cerning this operation. <br />Application Item 19: Your future land use of "Private fish and waterfowl <br />procreation" should be considered wildlife habitat for purposes of this re- <br />view. Some of my comments concerning reclamation will be based on this future <br />land use. <br />Exhibit A <br />I am still a bit confused as to the correct legal description for this opera- <br />tion. From the map given in exhibit B and your letter of August 12th, my <br />l / interpretation as to the correct legal description is as follows: "lying in <br />/~/\ the W~SWy, and the NW~NW~ of Sec. 30, T225, R46W of the 6th P. M.". Please <br />let me know if this is correct. If it is not correct, pleas_ try to further <br />clarify this description for me. <br />Exhibits C and D <br />1) The proposed permit boundaries need to be clarified. If the area to the <br />north of the Arkansas River is not [o be permitted, the boundary of the per- <br />X mit area that presumably lies to the south of the river should be shown on <br />the map. The area shown should equal the 67.42 acres asked for in the appli- <br />cation. <br />2) Although the area is said to be basically flat, more precise information <br />X concerning drainage on the site is needed. This is due to. the fact the pit <br />area is surrounded on three sides by water courses (a river and two canals}, <br />\ 9 3) Although it is evident from the map that the operator intends to avoid the <br />/X\ gas and power lines on the affected land during mining, how much distance is <br />
