.12/14/2004:~~ 12:25 3035825440 GILPIN COUNN PAGE 03

Future Use - It is the Cormty's contention that, at some point in the future,
the applicant, Clear Creek Water Providers I,LC, will. likely propose water
storage as apost-reclamation eAd use. "Muoicipat and industrial water
projects" is listed in Section 4.2 of Gilpin County ReguF~.pjon of Certain
Matters of State Interest (attached) as a major infrasttuchrre project subject
to 1D41 review. Aa such, it is likely that Gilpin County would exercise fts
10A l powers over any end use that would include water storage. As the
proposed quarrying project would irreversibly alter the natural landscape,
we believe it prudent to review the pmposod quarrying activity in the
context of rho likely end use before permitting.
The 112 application on file with the Gilpin Courny Clerk & Reoordor clearly
elates that a Crilpin Corwty Special Use Review (SUR) pemrit will be obtained
prior to initiating mining activity, "if this property is subjeot to Gilpin County
uaining regulations°. Gilpin County does not regulate mining per so, but the
County bas clear authority to, and loos regulate ofl'site impacts of mining and,
in this case, the and use o£ We mined area The above qualifying statement
coupled with Mr. Wolf a demonsbcated comiotions suggest that County
pctmits will not be sought.
Given the subject property owner's stated refusal to acknowledge the authority
of Coumy government contrary to local permitting requiremems, Gilpin
Coumy respectfully asks that the Mined [.and Reclamation 13oard deny the
applicant's permit request under §34-32.5-I 15 (4) (d) C,R.S. Alternatively,
GUpin County would request that any permit issued by the State clearly and
emphatically state that operation is conditioned upon local approvals,
Thank you for your consideration. We look forward to a public hearing and
will await notification.
<~~mlY, . .
o~nly/fP~ie~~r~ son
Gllpln County Commonity Development D'nector
o.c, Roger Bakes, Oi1P~ Cam' M~B~'
Jim Petcock, Oiipm Comoty Attoiney
BOCC
