I +\ <br />BEFORE THE MINED LAND RECLAMATION BOARD ~ <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AI jD ORDER <br />IN THE MATTER OF THE WATTENBERG LAKES APPLICATION OF AGGREGATE v~ <br />1/ INDUSTRIES _WCR, INC., OVER OB CTIONS, E NUMBER M-200~O1~j <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />November 17, 2004, in Denver, Colorado for a hearing to consider the Section 112 <br />._,~ <br />Construction Materials Application of Aggregate Industries -WCR, Inc. ("Applicant"). The <br />file number for this matter is M-2004-051. Tim Flanagan appeared on behalf of the <br />Applicant. Peter Baurer appeared on behalf of Stillwater Lake Ranch, LLC ("Objector"). <br />Gregg Squire and Steve Brown appeared on behalf of the Division of Minerals and Geology <br />("Division"). <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />The Applicant intends to extract sand and gravel from a 421-acre site located in Section 25, <br />Township 1 North, Range 67 West, 6`h Prime Meridian, Weld County, Colorado. Mining <br />will occur on approximately 245 acres within the proposed permit boundaries. The site is <br />known as the Wattenberg Lakes site. The proposed post-mining land use for the site is <br />developed water storage. <br />2. The Applicant submitted a complete permit application that was considered filed by the <br />Division on July 29, 2004. <br />The Division received timely written objections to the application from Feter Baurer of <br />Stillwater Lake Ranch, LLC, Andrea Benson of Wattenberg Improvement Association, and <br />
