Box 147 <br />Fairplay, Colorado 80440 <br />RE: Park County Pits <br />Our File Nos.: 1177-365,77-366;80-9 thru 80-19 inclusive; 80-251, <br />80-252 <br />Dear Mr. Freitag: <br />I have worked with Mark Loye the past month or so on the above applications, <br />and have subsequently acquired the files in entirety. <br />As the situation now stands, the law dictates that these applications be <br />heard before the January 28-29, 1981 Board meeting. However, there are <br />many questions which are still outstanding. It is doubtful as to whether you <br />would be able to respond fully by then. If they were to be presented to the <br />January Board as is, the staff would have no choice but to recommend denial <br />of the applications. Therefore, if the questions appearing below cannot be <br />returned by then, please submit a request in writing to continue the <br />consideration of the applications to the February meeting. <br />It is certainly not the State's intent to create undue hardship on anyone, but <br />in all fairness I must advise you that this situation has been unresolved for <br />too long and we must now take appropriate action. If we do not receive the <br />materials necessary to consider these applicaitons adequate by February 20th, <br />we will request the Board issue a Cease and Desist Order on all of the sand <br />and gravel pits operated by Park County. <br />It is realized that you have other important responsibilities and may not have <br />had the time to work on this. Perhaps the County Land Use Administrator or <br />Planning Officer would be able to offer assistance. <br />
