AUTHORIZATION TO DISCHARGE QNDER THE
COLORADO DISCHARGE PERMIT SYSTEM
Ia compliance with the provisions o~ the Colordda later Quality Coaerol Act.
(ZS-8-101 et. seq., C85, 1973 as amended) and the Federal Water Pollution
Control Act, as amended (33 Q.S.C. 1251 et. aeq.; the 'Act') the .•
KOUNTAIN COAL COMPANY
is authorized to discharge from nest Ilk Mine discharge facilities
located in the SE 1/4 of Section 9, T13N, R90W, 6th P.H., approz{mately 1 mile
east of Samezset, Colorado
to the North Fork of the Gunnison River, Sylvester Gulch and Minnesota Creek
in accordance with effluent limicaclons, monitoring requirements and other
conditions sec forth in Yart I, and IZ hereof. All discharges auG4orized
herein shall be consistent wi G`1 the terns and conditions of this permit.
The applicant may demand an ad judicatory hearing within. thirty (30) days of
issuance of the final pe_-miC determtaation, per the Regulations for the
{~te Discharge Permit System, 6.8.0 (1). Should the applicant choose to
Contest any of the effluent L*mitatioas, monitoring requirements or other
conditions contained herein, the applicant must comply with Seetlon 24-4-104
CRS 1973 and the Regulations for the State Discharge Permit System. Failure
to contest nay such effluent limitation, monitoring requirement, or a Goer
condition, constitutes consent to the condition by the applicant.
This permit and the authorizaeion to discharge shall expire at midnight,
March 31, 1945.
