D) During the pre-operational inspection, the operator agreed to have the <br />slurry wall design approved by SEO and have it in place prior to any <br />mining activity taking place and post the 20% warranty to DMG. <br />IV) EXHIBIT "E" RECLAMATION PLAN <br />A) It is the understanding of the Division that the post mining land use for the <br />proposed area is a lined a reservoir and that the substitute water supply <br />plan will be approved and a copy of the approval submitted to the Division <br />before any water is exposed in the proposed pernut area. <br />B) Under the soil information, bore holes indicated a range between 1 feet to <br />10 feet, but you only committed to placing 6 inches. The Division request <br />that you commit to placing a minimum of 12 inches ofoverburden/ top <br />soil over the entire 28.1 acres . <br />V) EXHIBIT "F" ADEQUATE <br />VI) EXHIBIT "G' WATER INFORMATION <br />A) Since the 100 year flood plain is with in the proposed permit area, the <br />operator must be in compliance with all the requirements of Urban Flood <br />Drainage Control. <br />B) The operator agrees to establish baseline water levels in all wells with in <br />600 feet of the pernut azea at lease once prior to mining. <br />C) Operator agrees to monitor monthly, all monitoring wells until mining <br />begins and quarterly after mining begins and until reclamation is <br />completed and the site is released from reclamation warranty .The <br />quarterly report to be submitted to DMG, on a semi annual basis. <br />D) During the pre-operational inspection, we agreed that the operator will <br />provide a ground water model, to show the probable impacts to the deep <br />wells and the aquifer, that aze being used as domestic wells. Operator also <br />agrees to mitigate all well owners with in 6000 feet of the pernnit azea, if <br />cause can be shown that the operation did impact the wells. The ground <br />water model must include probable impacts to Fulton Ditch specially <br />during the mining operation along the East side. <br />VII) EXHIBITS "H', "P', "J" AND "K' ADEQUATE <br />VIII) EXHIBIT "L" RECLAMATION COST <br />A) In your reclamation cost, you did not include the warranty needed to <br />remove the conveyer system under 104a' aue. In order to calculate the <br />warranty, the Division needs the dimensions for the systems and <br />associated parts. With out including the conveyer system, the Division has <br />calculated a financial warranty in the amount of $398,871. The detailed <br />calculation is enclosed with the adequacy. <br />B) As stated under Exhibit "E", the recalamtion warranty assumed 1 12 <br />inches cover ofoverburden/ top- soil over the entire 28.1 acres. <br />IX) EXHIBITS "M", "N", "O", "P" AND •`"Q" ADEQUATE <br />X) EXHIBIT "S" PERMANANET MAN MADE STRUTURES. <br />A) The operator agrees to conduct visual inspections of the excavated high <br />walls on a weekly basis for the first 6 months of mining. This inspection <br />will include, walking the existing ground and looking for any signs of <br />stress cracks or other potentials of slope failure. <br />
