IN PE TION - It is agreed that during all proper hours and at all times during the continuance of this lease <br />Lessor, or its duly authorized agent, shall be, and hereby is authorized to go through any of the openings or <br />workings on said premises, and to examine, inspect and survey the same and to examine and make extracts or <br />copies of all books and sheets which show in any way the output of the leases premises, and that all conveniences <br />necessary for said inspection, survey or examination shall be furnished to Lessor, or its agent, by Lessee. <br />19. )~pj,~,ATION DATA - It is agreed that Lessee, while using any drill on said premises during the term of this <br />lease, shtdl keep an accurate log of all work so done and performed, showing the formations penetrated, the depth <br />of thickness of each, the chazacter of each, their elevations, the location of same by tying to corner of some legal <br />subdivision or, in unsurveyed territory, to some bench mark or other officially established point, established by <br />the United States surveys, and each and every thing necessary to make and supply a perfect and complete log of <br />the hole throughout its entire depth, a true copy of said log shall be furnished Lessor when and at the time such <br />holes are drilled or at any time thereafter upon demand of Lessor. <br />20 MAPS -- Lessee shall provide Lessor with a map of the workings herein authorized to be made yearly by an <br />engineer or surveyor duly licensed by the State of Colorado, on a scale of not less than 100 feet to the inch, <br />showing the vertical and horizontal dimensions of all excavations, fills, stockpiles, and other disturbances of the <br />surface, by means of accurate contour lines (not more than two-foot interval) or cross-sections, all to be correctly <br />related to a base line which is properly located in relation to known section lines in the area; said map to show <br />county, section, township, and range, the name of the company or operator, the North point, the scale to which <br />the map is drawn and explanatory legend, and the certificate to the State of the engineer or surveyor as to its <br />accuracy. The engineer or surveyor shall show clearly upon said map the cubic yards of material displaced and <br />removed by the operation since the previous survey, map, and report. <br />Maps and plans hereinbefore mentioned shall be extended and corrected at least once each year. True copies of <br />all maps ;utd plans shall be provided as follows: The original maps and tracings to be kept in the office of the <br />engineer or surveyor, blue or white prints certified to by engineer to be on file at the office of the State Boazd <br />of Land Commissioners, Denver, Colorado. Any request to keep certain information confidential should be in <br />writing to Lessor at the time such information is submitted to Lessor, and such data may be kept confidential as <br />consistent with State law. <br />21. ANCILLARY USE --This lease allows for the removal of the aforementioned material and the placement of such <br />equipment. as necessary for this removal, such as mining equipment, conveyors, wash and screening plants, scale <br />and scale house, office, repair facility for this equipment and vehicles used on site, stock piles of material mined <br />from this lease and any other equipment agreed upon between Lessor and Lessee. <br />All other tmcillary uses such as concrete plane, asphalt plants, accessory equipment, off site aggregate materials <br />and any ocher uses not specifically mentioned herein will be subject to approval by Lessor and will require a <br />yearly rental payment of no less than one and no/100 - Dollaz per acre. Haul roads not on this lease but on <br />other Statt: lands will be subject to a separate permit and require approval of the Board of Land Commissioners. <br />22. NOTICES -Any notice required to be given to Lessee under the provisions of this lease shall be sent by certified <br />mail to the address set forth at the beginning of this lease or to such other address as Lessee may indicate in <br />writing to Lessor, and such service by mail shall be deemed sufficient and in full compliance with the terms of <br />this lease as of the date it is postmarked. Notice [o Lessor shall be given in like manner, addressed to the State <br />Boazd of Land Commissioners' Denver, Colorado address. <br />23. RIGHT O1~ REMOVAL -- In the event this lease is terminated by forfeiture, surrender or the expiration of its <br />term, and all obligations of Lessee under this lease aze satisfied, all Lessee's improvements, equipment, <br />man-made objects or any type, stockpiles and dumps shall be removed from the leased premises within six months <br />from the date of such termination at Lessee's expense. Such removal is to be accomplished without unnecessazy <br />waste of damage to the premises and Lessee shall restore the surface of the leased premises to the same condition <br />as immediately prior to the execution of this lease.
