5.0 CONCLUSIONS
<br />Specifically, it is determined that the above impacted wetland areas are not considered Waters of the United
<br />States, are not regulated by the Rivers and Harbors Act of 1899, nor are they classified as Section 10 waters
<br />under the Clean Water Act (CWA) as they are wholly intrastate, non-navigable, and hydrologically isolated
<br />from above identified Waters of the United States within the project area.
<br />Mining operations (e.g. excavation) will not occur within 100 ft. of the Florida River course and as such
<br />will not impact any waters of the United States identified along its length within the property. Staging, and
<br />product stockpiling, as well as constmcted storm water detention facilities will be within 100 feet of the
<br />Florida river course within an upland area, and protected from entering the river by an overburden bean
