COMPLIANCE INFORMATION <br />Pursuant to Rule 2, Section 3.5131 of the Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining, the attached is a listing of each violation notice received by Seneca Coal Company for <br />the period January 1, 1997 to January 1, 2000 for any violation of a provision of the Act, or of any <br />law, rule, or regulation of the United States, or of any State law, rule, or regulation enacted pursuant <br />to Federal law, rule, or regulation pertaining to air or water environmental protection incurred in <br />connection with any surface coal mining operation. A list of all unabated cessation orders and <br />unabated air and water quality violation notices received prior to January 1, 2000 by any surface coal <br />mining and reclamation operations owned or controlled by either Seneca Coal Company or by any <br />person who owns or controls Seneca Coal Company is also included. <br />For each violation notice or cessation order reported, the list includes the following information: <br />1. Any identifying numbers for the operation, including the Federal or State permit number and <br />MSHA number, the dates of issuance of the violation notice and MSHA number, the name of the <br />person to whom the violation notice was issued, and the name of the issuing regulatory <br />authority, department, or agency; <br />2. A brief description of the particular violation alleged in the notice; <br />3. The date, location, and type of any administrative or judicial proceeding initiated concerning the <br />violation, including, but not limited to, proceedings initiated by the applicant to obtain <br />administrative or judicial review of the violations; <br />4. The current status of the proceedings and of the violation notice; <br />5. The actions, if any, taken by the applicant to abate the violation; and <br />6. The final resolution of any notice of violation. <br />It should be noted that the attached represents a complete listing of the above-described violation <br />notices or cessation orders and their status as reflected by the file of the Office of the General Counsel <br />of Peabody Holding Company,~lnc., 701 N. Market Street, Suite 700, St. Louis, Missouri 63101-1826, <br />as of January 1, 2000. Seneca Coal Company reserves the right to supplement this listing to reflect <br />any information received by the Office of the General Counsel after said date. <br /> <br />Revised 1 /00 <br />
