Mr. Mark Klune - 2 - July 29, 1988
3. Upon completion of mining, water from the arroyo will flow into the
pit. You will need to stabilize the area where this water flows
from the surface of the surrounding area down the pit slope to the
water level--about a 3:1 gradient. We recommend placement of rip
rap here. You should contact the State Engineer's Office to
determine the status of water rights for the water which flows in
the arroyo. If this water is owned by persons or companies other
than Valco, you should plan to allow that water to flow out of the
pit. If this is the case, we recommend that an engineered spillway
be designed and built along the north end of the pit adjacent to
the Arkansas River.
4. All areas where the diversion will be built should be included in
the permit area. Wi11 this be the case?
In order to complete the acceptance of this information you provided to
satisfy Stipulation No. 2, could you please respond to these questions within
the next 90 days, or roughtly by the end of October, 1988?
Thank you for working with us to resolve these matters, and I look forward to
hearing from you. If you have any questions or need additional time, please
contact me.
Sincerely,
G ~
Patricia C. Martinek
Reclamation Specialist
PCM/scg
9151 F
