Mr. Mark Klune - 2 - July 29, 1988 <br />3. Upon completion of mining, water from the arroyo will flow into the <br />pit. You will need to stabilize the area where this water flows <br />from the surface of the surrounding area down the pit slope to the <br />water level--about a 3:1 gradient. We recommend placement of rip <br />rap here. You should contact the State Engineer's Office to <br />determine the status of water rights for the water which flows in <br />the arroyo. If this water is owned by persons or companies other <br />than Valco, you should plan to allow that water to flow out of the <br />pit. If this is the case, we recommend that an engineered spillway <br />be designed and built along the north end of the pit adjacent to <br />the Arkansas River. <br />4. All areas where the diversion will be built should be included in <br />the permit area. Wi11 this be the case? <br />In order to complete the acceptance of this information you provided to <br />satisfy Stipulation No. 2, could you please respond to these questions within <br />the next 90 days, or roughtly by the end of October, 1988? <br />Thank you for working with us to resolve these matters, and I look forward to <br />hearing from you.
