~ M <br />l2) Exhibit C -Rule 6.3.3(j) -Specify how you will comply with applicable Colorado water <br />laws and regulations governing injury to existing water rights. A letter from [he Office of the <br />State Engineer stating compliance with water laws will be required. Or, a financial warranty in an <br />amount equal to the cost of backfilling the pit will be required. <br />13) Exhibit C -Rule 6.3.3(1) -Describe what measures will be taken to minimize disturbances <br />to the hydrologic balance, prevent off-site damage, and provide for a stable configuration of the <br />reclaimed azea consistant with the proposed future land use. <br />14) Exhibit C -Rule 6.3.3(m) -Specify whether the deposit will be processed on-site. If the <br />deposit will be processed, then describe the nature of the process and the facilities. <br />15) Exhibit D -Rule 6.3.4(b) -You state that slopes in the disturbed area will be graded to <br />3:1. This, of course, will apply to the pond because the depth of the pond is proposed to be only <br />10 feet deep and the side slopes "from 5 vertical feet above to 10 vertical feet below the expected <br />average water level cannot be steeper than 3H:1 V." (See Rule 6.3.4(d)). Will the slopes be <br />graded after mining ceases or will the pit be mined at a 3:1 slope? <br />16) Exhibit D -Rule 6.3.4(c) -You state that topsoiling, discing and seeding will comply with <br />,/ USSCD guidelines. Where is the USSCD guideline sheet? You need to submit [he USSCD <br />guideline sheet or address this part of Rule 6.3.4(c) (i through vi). <br />/~ 17) Exhibit D -Rule 6.3.4(f) -Your bond calculation proposal states that 7.5 acres will be <br />disturbed. However, you delineated just a little over 3 acres on the Exhibit A & C map and 9.8 <br />acres on the Exhibit D map. How much acreage will ultimately be disturbed? <br />18) Exhibit D -Rule 6.3.4(f)(4) -After the direct costs have been estimated, the Division will <br />,/ add up to an additional 18.5%o for overhead and profits and 5.0% to cover Office administration <br />costs in the event of bond forfeiture and permit revocation. <br />19) Exhibit E -Rule 6.3.5 -The Mining Plan map and the Reclamation Plan map must show <br />the existing and proposed roads to be used in conjunction with the mining operation. Also, the <br />access roads must be included in the reclamation plan and funds must be included in the bond to <br />reclaim the road (unless the road will be left for the beneficial future use of the landowner). <br />Prior to Division consideration of the application, you need to submit proof of publication and <br />proof of all required notices. <br />Please be advised that the permit application may be deemed inadequate, and your application <br />may be denied on July 17, 2000, unless the above noted adequacy items are addressed to the <br />satisfaction of the Division. If you determine you need additional time to address the above noted <br />adequacy items you may, pursuant to Rule 1.4.2(3), request an extension of the decision due date <br />(not to exceed 365 days from the date the Office officially accepted the application for review). <br />
