MAY Q 5 7999
Dear Mr. Deaver: Jlv1 ~'cn OlMinere9 6 Geology
Thank you for your review and comments on Castle Concrete's proposed Holnam Gravel Pit
application, particulazly with respect to the potential effects on your gas line which crosses the
southern edge of the property. As discussed on April 13, 1999, Castle Concrete will strictly observe
the following precautions. This list provides the terms of an agreement between Castle Concrete and
Greeley Gas Company regarding the mining of gravel on this site.
1. Greeley Gas Company, prior to Castle Concrete initiating mining, shall mark the exact
location of the gas line along the entire length of the gas line that is adjacent to or within
approximately 200 feet of land that will be mined.
2. Castle Concrete shall define and mazk a line not less than 100 feet from the exact location of
the gas line. This line shall define the maximum extent of the top of the excavation slope or working
face adjacent to the gas line corridor. No removal of material shall occur between this 100 foot line and
the actual location of the gas line.
3. In the event erosion, slope collapse or other processes results in an encroachment of the
excavation into the 100 foot setback, Castle Concrete shall take immediate and reasonable action to
return the encroachment to at least the 100 foot setback line using methods appropriate to the
situation so as to avoid the possibility of exposing or damaging the gas line.
If this is acceptable to you please provide myself with a letter affirming your acceptance of these terms.
If you wish to discuss this further, please call. A copy of this letter and your affirmation must be
provided to the Division of Minerals and Geology. Once I have your letter that submittal can be
made.
Thank you for your consideration and help in resolving this issue.
Mark A.
cc: Rick
