d) Burden o! Proof Requirement
Ths persittea has the burden of proo! when raqueeting relic! lros
total euapended solids (TSS), total iron and/or settleable solids
limitations. Relic! shall be granted only whoa necessary and shall
not be granted when the psrmittee has control over the discharge.
The persittee should endeavor to mast the primary limitations
whenever possible.
1) For rainfall. to waive TSS and total iron limitations, it ie
necessary to prove that discharge occurred within 48 hours after
measurable precipitation has stopped. In addition, to waive
settleable eolida limitations, it i• necessary to prow that
discharge occurred within 48 hours after precipitation greater
than the 10-year, 24-hour event has stopped.
2) For enowmelt, to waive TSS and total iron limitations, it i•
necessary to prove thnt discharge occurred within 48 hours after
pond inflow has stopped. In addition, to waive settleable eolida
• limitations, it ie necessary to prove that discharge occurred
within 48 hour^ after pond inflow volume greater than the 10-year,
24-hour event has stopped.
The Division shall determine the adequacy of proof. As part o! this
determination, the Division shall evaluate whether the permittee
could have controlled the discharge in such a manner thst primary
limitations could have been met. All manual dewaterinq moat meet TSS
and total iron limitations.
2. Stormwater Nanaaemsnt Plan fSNNP)
A Stozmwater Management Plan (SNNp) shall be developed for the portion
of each facility covered by this section of the permit. The SWMP ehsll
be prepared in accordance with good engineering practices. (The plan
need not be completed by a registered engineer.)
The plan shall identify potential sources of pollution (including
sediment) which may reasonably be expected to affect the quality of
etormwater discharges associated with the mining operation. In
addition, the plan shall describe and ensure the implementation o! beet
management practices (BMPe) which will be used to reduce the pollutants
in etormwater discharges associated with mining activity.
