Proof Requirement <br />Ths persittea has the burden of proo! when raqueeting relic! lros <br />total euapended solids (TSS), total iron and/or settleable solids <br />limitations. Relic! shall be granted only whoa necessary and shall <br />not be granted when the psrmittee has control over the discharge. <br />The persittee should endeavor to mast the primary limitations <br />whenever possible. <br />1) For rainfall. to waive TSS and total iron limitations, it ie <br />necessary to prove that discharge occurred within 48 hours after <br />measurable precipitation has stopped. In addition, to waive <br />settleable eolida limitations, it i• necessary to prow that <br />discharge occurred within 48 hours after precipitation greater <br />than the 10-year, 24-hour event has stopped. <br />2) For enowmelt, to waive TSS and total iron limitations, it i• <br />necessary to prove thnt discharge occurred within 48 hours after <br />pond inflow has stopped. In addition, to waive settleable eolida <br />• limitations, it ie necessary to prove that discharge occurred <br />within 48 hour^ after pond inflow volume greater than the 10-year, <br />24-hour event has stopped. <br />The Division shall determine the adequacy of proof. As part o! this <br />determination, the Division shall evaluate whether the permittee <br />could have controlled the discharge in such a manner thst primary <br />limitations could have been met. All manual dewaterinq moat meet TSS <br />and total iron limitations. <br />2. Stormwater Nanaaemsnt Plan fSNNP) <br />A Stozmwater Management Plan (SNNp) shall be developed for the portion <br />of each facility covered by this section of the permit. The SWMP ehsll <br />be prepared in accordance with good engineering practices. (The plan <br />need not be completed by a registered engineer.) <br />The plan shall identify potential sources of pollution (including <br />sediment) which may reasonably be expected to affect the quality of <br />etormwater discharges associated with the mining operation. In <br />addition, the plan shall describe and ensure the implementation o! beet <br />management practices (BMPe) which will be used to reduce the pollutants <br />in etormwater discharges associated with mining activity. <br />Miaiag operations oust Saplement the provisions of the SNMP required <br />under this part as • coaditioa of this pereit.
