SNOWCAP COAL COMPANY, INC. <br />• TABLE 3-2 <br />NOTICE OF VIOLATION LIST <br />Other than the Notice of Violations listed below, Snowcap Coal Company, Inc. has not <br />had any other violation notices pertaining to any provision of the Act, or of any law, rule <br />or regulation of the United States, or of any State law, rule or regulation enacted <br />pursuant to Federal law, rule or regulation pertaining to air or water environmental <br />protection during the three year period preceding the date of this page revision. <br />(a) Notice of Violation: CV-2002-018 <br />Issued by: Division of Minerals 8~ Geology <br />Issued to: Snowcap Coal Company, Inc. <br />Issued on: September 16, 2002 <br />(b) The violation was issued for failure to construct or maintain disturbed area <br />drainage collection pipes to function as designed, to ensure that adverse impacts <br />to hydrologic balance are minimized. Specifically, apparent leak in collection <br />pipe has developed, because water inflow at upper end does not discharge <br />through pipe outlet into Pond 8 per approved design. Also, outlet pipe diameter <br />is 6" rather than 8"diameter specified in map 66. <br />(c) No administrative or judicial proceedings were initiated. <br />• (d) The violation has been abated. <br />(e) Technical Revision No. 40, addressing the NOV issues, was submitted by <br />applicant and approved by the Division of Minerals and Geology. Applicant <br />initiated measures, as approved in TR-40, to modify and replace the existing <br />buried PVC pipe drain system with 6" flexible pipe. <br />(f) The notice of violation was terminated by the Division of Minerals and Geology <br />on October 28, 2002. A civil penalty of $750 was assessed by the Division of <br />Minerals and Geology and paid by the applicant. <br />(a) Notice of Violation: CV-2002-019 <br />Issued by: Division of Minerals & Geology <br />Issued to: Snowcap Coal Company; Inc. <br />Issued on: September 16, 2002 <br />(b) The violation was issued for failure to conduct mining and reclamation operations <br />in a manner to minimize erosion.
