Rule 6.4.13 Exhibit M- Other Permits and Licenses <br />14. Exhibit M requires the Operator/Applicant to provide a statement identifying which permits, licenses and approvals the <br />Operator/Applicant holds or will be seeking in order;3o conduct the proposed mining and reclamation operations, The <br />Applicant lists the permits that Hall-Irwin will be applying,for prior to mining. Please be awaze that if any changes aze <br />made to the mining or reclamation plans necessary fob approval of these permits, the Division must receive notice of <br />these changes through submittal of an amendment or technioal revision application. ~~ <br />Rule 6.4.16 Exhibit P - Municipalities Within Two Miles <br />I5. Exhibit P requires the ApplicanUOperator to provide a list of any;municipalities within two miles of the proposed mining <br />operation and the address of the general office of each municipalify'_ Exhibit P indicates that the site will be within two <br />miles of the town of Milliken once an annexation occurs, 'and'if~is'located approximately two miles from the town of <br />7ohnstown. Please supply the addresses of the general offices for the towns of Milliken and Johnstown. <br />Rule 6.5 Geotechtrical Stability Exhibit <br />16. Section (2) of the Geotechnical Stability Exhibit states that on'a site-specific basis, an Applicant shall be required to <br />provide engineering stability analyses for certain slopes configuration, as they will occur during operations, including, but <br />not limited to embankments. Please refer to the enclosed memo from Allen Sorenson, DMG, addressing the <br />geotechnical stability exhibit submitted with the permit application. <br />Please be advised that the Hall-Irwin Corporation, Bernhardt Resource, 112(c) Permit Application may be deemed <br />inadequate, and the application may be denied on Mazch 26, 2003 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can grant an <br />extension to the decision date. This will be done upon receipt of a written waiver of your right to a decision by Mazch 26, <br />2003 and request for additional time.
