Cattany <br />Division Director <br />Listed below are adequacy review comments for the Bemhazdt Resource 112(c) Permit Application, File No. M-2002-120. <br />The Division of Minerals and Geology ("Division") is required to make an approval or denial decision no later than Mazch <br />26, 2003, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />1. Rule 6.2.1(2) requires that maps be prepared and signed by a registered land surveyor, professional engineer, or other <br />qualified person. The maps submitted to the Devision were not signed. Please submit the proper, signed maps to the <br />Division. <br />Rule 6.4.3 Exhibit C-Pre-minine and Mining Plan Man(s) of Affected Lands <br />2. Section (e) of the Pre-Mining and Mining Plan Maps of Affected Lands requires the Operator/Applicant to specify the <br />type of present vegetation covering the affected lands. The map submitted with the permit application states that the only <br />present vegetation consists of irrigated pastweland and cultivated fields. The application refers to cottonwood trees and <br />a riparian corridor and the map itself depicts trees and shrubs present at the site. Please identify any vegetation present at <br />the site in addition to the crops and pasture. <br />3. Section (g), states Ute Pre-mining or Mining Plan Map(s) aze required to show the owner's name, type of structures, and <br />location of all significant, valuable and permanent man-made stmctlues contained on the area of affected land and within <br />two hundred feet of the affected land. The maps and the geotechnical stability report identify a number of permanent <br />man-made structures but do not identify the owners' names. Please state the owners' names of all the, gas lines, utility <br />lines, water wells, residences, irrigation ditches, and all other structures on and within 200' of the affected land. <br />Rule 6.4.4 Exhibit D-Mining Plan <br />4. Section (a) of the Mining Plan requires the Operator/Applicant to supply a description of the method(s) of mining to be <br />employed in each state of the operation as related to any surface disturbance on affected lands. The Applicant states that <br />the Operator may process material imported from other sites. Please be aware that Section 3.1.5(9) requires that if the <br />Operator intends to backfill inert structural fill generated outside of the approved permit area, it is the Operator's <br />responsibility to provide the Office notice of any proposed backfill activity not identified in the approved Reclamation <br />Plan. If the Operator intends to use any incidental materials resulting from the processing of off site materials, the <br />Operator must supply the Division with (a) a narrative that describes the approximate location of the proposed activity; <br />(b) the approximate volume of inert material to be backfilled; (c) a signed affidavit certifying that the material is clean <br />and inert, as defined in Rule 1.1(20). <br />
