2.01.4 Permit Reovirements for New Surface Coal Mining and <br />Reclamation Operations <br />Because the Colowyo operation is an existing mine, the requirements <br />of this Section are not applicable to Colowyo. <br />2.01.5 Permit Term <br />Colowyo originally submitted the initial permit application with a <br />request for life-of-mine approval because Colowyo has three <br />long-term contracts with major electric generating facilities, <br />because of the nature of these contracts, and the extensive capital <br />expense commitment made by Colowyo. The Division determined that a <br />variance of the standard five-year permit term could not be granted <br />since the specific financial justifications could not be provided. <br />However, it was determined by the Division that the initial <br />application was complete for the life-of-mine. Subsequently, the <br />Division made findings and on November 11, 1982 approved the entire <br />permit area, which also represented the initial life-of-mine area. <br />The initial permit area had the right of successive renewal for <br />successive five-year permit terms. <br />Colowyo is hereby submitting the complete information necessary for <br />the Division to make a finding that the permit revision <br />incorporating Federal Lease C-29224 and State Coal Lease 257/135 is <br />complete for the life-of-mine. With approval of this application, <br />we are requesting approval of the entire permit area which also <br />represents the life-of-mine area. Consistent with this approach <br />the revised permit area will then again have the right of <br />successive renewal for successive five-year permit terms. <br />2.01.6 Permit Fees <br />As required under this section of the Colorado regulations, Colowyo <br />previously submitted a'permit fee of $2,500. There are approxi- <br />mately 7,402.49 acres within Colowyo's permit area. <br />2.01-2 <br />
