Item 30: The geotechnical stability analysis from Revey Associates, Inc. was sent previously.. Response <br />to additional concerns by Greg Lazear will come under separate cover. Concerns about the project <br />affecting stability of old coal mines in the azea were addressed in the conclusions in the original report. <br />Item 31: <br />a) The statement by Welch that he could not find evidence that the applicant has filed for other <br />required state permits is because the applicant has not yet applied for such permits. It is our <br />understanding that all the permits are required before mining can begin, but there is no <br />requirement that they be filed concurrently. We have completed the Delta County Specific <br />Development Permit process and are now working through the DMG process, We will apply <br />for the Stormwater Dischazge Permit and Air Pollution Permit fro the Colorado Department of <br />Public Health and Environment once we have finalized the Reclamation Pemut. <br />b) The possible destabilization of neazby underground mice workings were addressed by Revey <br />Associates, Inc geotechnical report and follow up information. <br />c) Soils and vegetation exhibits from the Natural Resource Conservation Service identify their <br />maps and descriptions as Paonia Survey Area. However, the descriptions correlate directly to <br />the identified mapping unit on the soils map, which specifically shows the site in question. It <br />appears that the Colby Canyon area is considered part of the Paonia Survey Area by NRCS. <br />Please let me know if there is any additional information that you need.
