According to the permit, L.G.
Everist is in fact permitted to place inert fill in the ponds. However, notice to DMG in accordance with the
Construction Materials Rules and Regulations 3.1.5 is still required before placement of material.
SpeciFcally, a written affidavit that the fill to be placed is clean and inert, as defined in Rule I.1(20), must
be submitted prior tD any Cilling, especially since the Division understands that the location from which the
fill is to be obtained has changed since the initial application.
If you have any fruther questions, please contact me at (303) 866-3567.
Sincerely,
Christina L.
