According to the permit, L.G. <br />Everist is in fact permitted to place inert fill in the ponds. However, notice to DMG in accordance with the <br />Construction Materials Rules and Regulations 3.1.5 is still required before placement of material. <br />SpeciFcally, a written affidavit that the fill to be placed is clean and inert, as defined in Rule I.1(20), must <br />be submitted prior tD any Cilling, especially since the Division understands that the location from which the <br />fill is to be obtained has changed since the initial application. <br />If you have any fruther questions, please contact me at (303) 866-3567. <br />Sincerely, <br />Christina L.
