My clients appreciate your reconsideration of the Stone Gravel Pit <br />application in light of the recent changes to the application. The recent additions support my <br />clients' previous submissions and position that the Mined Land Reclamation Board (MLRB) <br />cannot legally approve this application. These submissions have also detailed several legal <br />grounds that allow MLRB to deny the application. <br />The application file contains a "technical revision" (my clients respectfully maintain the <br />position that these submissions qualify as an "amendment") filed with the Montezuma County <br />Clerk and Recorder on January 23, 1998. The notice of the filing was submitted to DMG on <br />January 27, 1998. All of the documents so filed are now part of the application and must be <br />properly considered before making a recommendation. Further, my clients hereby reserve the <br />right to raise at the formal hearing in Denver any an all issues related to the January 27, 1993, <br />filing. New issues not included in the scope of this comment period and not known before the <br />
