Rationale, Page 6. <br />This document outlines the criteria used 6y the Division in such areas as granting relief from WET testing <br />modifying test methods and changing rest species. The permittee should 6e aware that some of the condition <br />outlined above may be subject to change if [he facility experiences a change in discharge, as outlined in Pm <br />O.A.1. ojthe permit. Such chnnges shall be reported to the Division immediately. <br />3. Ctnrrnwnter Fvnluntinn Stornnvater from sand and gravel facilities is required to be covered by a Colorado Dischnrge <br />Permit System (CDPS) permit in order to be discharged to Waters of the State. However, it is the Division's <br />understanding that all stormwater runoff from Fruity bfarketing and Management's facility is discharged to the <br />sedimentation pond, ~t~here it will commingle with the process water. <br />!J there is no discharge of stormtivaler to Waters ojthe State, then a stormwater discharge permit is not necessary. Ij <br />conditions at the site change such that a stormwater discharge Wray occur, then stormwater discharge coverage must <br />be applied for. Ifneeded, the Division's stormwater Program will handle stormwater-permitting issues for this facility <br />separately, although this permit may bereopened later to incorporate stormwater provisions, if deemed appropriate. <br />4. Frnnnmir Rvacnnnhlanacs FvrtTrrnrinn: Section 25-8-503t8J of the revised (June /985J Cnlnrndn Girnror rnli (-nnrr <br />dct required the Division to "determine whether or not any or all ojthe water quality standard based effluent limitatim <br />are reasonably related to the econoric, environmental, public health and energy impacts to the public and affere <br />persons, and are in fw-therance ojthe policies set forth in sections ZS-8-f9Z and 15-8-104." <br />The Colorado Discharge Permit System Regulations, Regulation No. 61, further define this requirement under 61.11 ar <br />state: "Where economic, environmental, public health and energy impacts to the public and affected persons have beF <br />considered in the classifications and standards setting process, permits written to meet the standards may be presume <br />to have taken into consideration economic factors unless: <br />aJ Anew permit is issued where the discharge was not in ecisrence at the time of the classifccation and startdar <br />rulemaking, or <br />~ bJ /n the case oja continuing discharge, additional information ar factors have emerged that were not anticipated <br />considered at [he time of the classification and standards ru[emaking." <br />The evaluation for this permtt shows that this is a new facility not in ecistence at the h'me of water quality stnndar <br />rulemaking. However, based on available data, the resulting water quality standard-based effluent limitations c <br />determined to be reasonably related to the economic, environmental, public health, and energy impacts to the public c <br />affected persons.
