maximum thirty (30) foot wide roadway. <br />3. EQIIIPMENT, Elam shall have the right to install machinery, <br />equipment, personal property, telephone lines, electric lines and <br />water lines in and on the leased premises and shall have the right <br />to remove such property from the premises at the end of the lease <br />term. Elam shall save the Lessor harmless from all taxes, which <br />may be levied against the property installed by Elam, or against <br />any stockpiled materials. Lessor shall remain responsible fqr the <br />payment of ad valorem real property taxes before the same become <br />delinquent. <br />4. TERM. Elam agrees to proceed with due diligence and make any <br />necessary application to Mesa County, Colorado, for a permit to <br />extract gravel from the leased premises and make application to <br />the State of Colorado, Division of Minerals and Geology for the <br />issuance of a gravel permit relating thereto, and to make <br />application to any other relevant agency for permits for any other <br />operations of Elam on the premises which may require a permit. If <br />either of such permits is denied then this Lease Agreement shall <br />terminate and be of no further force and effect. If both permits <br />are granted the lease term shall be for a period of ten (10) years <br />with an option fox an additional five (5) years as provided in <br />greater detail hereinafter. Lessor reserves the authority to alter <br />reclamation plans which may be required by any permitting agency <br />to the extent that such requirements are compatible with the <br />permits, are approved by the permitting agency and do not <br />materially increase Elam's reclamation costs. Elam shall be <br />responsible for obtaining and paying fox all necessary permits to <br />operate and gravel facilities, i.e.: annual fees, transfer fees, <br />and permits from the IIS Government, the State of Colorado, and <br />Mesa County. Lessor agrees to assist in completing the permit <br />applications by providing necessary documentation that may be <br />required by the various governmental agencies. <br />5. PAYMENT. As consideration for this Lease Agreement, and each <br />and every covenant herein contained, Elam agrees to make payment <br />to Lessor as follows: <br />A. On the effective date of the term of this Lease <br />Agreement, Elam shall pay to Lessor Twenty Thousand Dollars <br />($20,000.00) which shall serve as the initial annual rent. <br />Elam shall pay an annual rent to Lessor Thirty Thousand <br />Dollars ($30,000.00) on each anniversary date of this ~~~~ <br />agreement. The annual rent shall be a credit against the <br />first payments due to Lessor pursuant to Paragraph,Il~ ~ Q <br />following date of payment. <br />B. Elam shall pay Lessor Sixty-five Cents ($0.65) per ton <br />2 <br />
